Introduction
These Terms and Conditions constitute a legally binding agreement between the user (Customer or Service Provider) and Noha Sindi Fashion Establishment (Establishment or We), the owner of the FC by Noha Sindi application (Application). By using or registering on the Application, the user expressly agrees to be bound by these Terms and Conditions, which govern all transactions and services provided through the Application.
At FC by Noha Sindi, we are committed to providing a reliable and luxurious experience in the world of fashion, beauty, and style, adhering to the highest standards of quality and professionalism. We also ensure transparency and security in all transactions within the Application, giving our Customers confidence and peace of mind at every step.
If you do not agree to any of these terms, you shall immediately refrain from using the Application or benefiting from its services. The Application reserves the right to amend these terms at any time, and continued use of the Application after any modifications are posted shall constitute explicit acceptance of such modifications.
(2) Definitions
For the purposes of these Terms and Conditions, Privacy Policy, and any other policies of ours, the following terms shall have the meanings set forth below, unless the context requires otherwise. This section helps clarify the concepts and terms used in this agreement to ensure accurate and consistent understanding by all parties. These definitions are binding references for all parties and shall be interpreted in accordance with the legal and regulatory context applicable within the Kingdom of Saudi Arabia. Any references made using singular or plural pronouns shall be directed to the relevant parties as defined below:
Application, Platform, Establishment, We, Us, or Ourrefers to the electronic platform FC by Noha Sindi and Noha Sindi Fashion Establishment, a commercially registered entity in the Kingdom of Saudi Arabia. It is the sole owner and operator of the FC by Noha Sindi Application, providing Customers with access to purchase services and products available, either directly from the Establishment or through registered service providers within the Application.
User, You, Your, or Yours refers to any individual or legal entity who downloads and uses the FC by Noha Sindi Application (hereinafter referred to as the Application) on their mobile device or any other device, in accordance with these Terms and Conditions. It includes Users who browse the Application, register an account, or purchase products and services offered through the Application.
Customer refers to any natural person who has reached the legal age, registers on the Application to benefit from the services or purchase the products available through it, and agrees to comply with all the Terms and Conditions set forth in this Agreement.
Team refers to the team associated with the Application that provides any of the services and/or products offered by the Application to Customers in accordance with the Terms and Conditions of this Agreement.
Service Provider refers to any natural or legal person registered on the Application who provides any of the services offered by the Application (such as hairstyling, beauty services, etc.) to Customers through the Platform, in accordance with the Terms and Conditions of this Agreement.
Services refers to all services provided through the Application, which fall under the categories of available services within the Application, and any other related services offered by the Application or registered Service Providers on the Application.
Products refers to any goods or items offered for sale through the Application, whether provided directly by the Application, through available offers to Customers within the Application, or by registered Service Providers on the Application.
Account refers to the electronic profile created by the User through the Application, containing their personal information, and allowing them to access the services and products offered through the Platform, in accordance with the Privacy Policy and the terms governing the use of the Application.
Payment Methods or Payment Gateways refers to the approved electronic methods for paying for services or products through the Application. This includes our approved payment gateways and payment methods such as (Visa, MasterCard, Mada, Apple Pay, Google Pay), in accordance with the applicable regulations and laws.
Order or Your Order or Service Order or Purchase Order or Booking Orderrefers to the action taken by the Customer within the Application to select a specific service or product and complete the booking or purchase process, including specifying necessary details such as the date, location or place of service provision, and payment method.
Commercial Policy refers to the set of rules and conditions governing the processes of purchase, payment, cancellation, returns, and the guarantee of quality for services provided through the Application, which form an integral part of these Terms and Conditions.
Agreement refers to these Terms and Conditions governing the use of the FC by Noha Sindi Application by Users. This Agreement includes all laws and regulations defining the rights and obligations of the User and the Application owner regarding the use of the Application, as well as any updates or changes that may occur to these Terms. By completing the download and use of the Application, the User acknowledges and agrees to fully comply with this Agreement.
Content refers to all materials and data available through the FC by Noha Sindi Application, including but not limited to: texts, images, graphics, designs, videos, audios, logos, presentations, software, information, and any other form of content provided by the Application or Users, whether it is proprietary content of the Application owner or content created or published by Users.
Review refers to the mechanism available to Customers within the Application to leave their opinions regarding the quality of services provided by the Application or Service Providers, in accordance with the established guidelines that prevent defamation or misconduct.
Law refers to the laws and regulations in force in the Kingdom of Saudi Arabia, to which this Agreement and all transactions conducted through the Application are subject.
(3) Description of Services
• At FC by Noha Sindi, we provide a range of services specifically designed to enhance your appearance and simplify your life, as we believe that style is a personal experience that each individual can enjoy. Our services include, but are not limited to: (personalized fashion coordination, personal shopping tours and assistance, event outfit planning, wardrobe consultations, wardrobe organization, customized wardrobe design and planning, trend analysis, and specialized workshops on style), and any other services offered through the Application.
At FC by Noha Sindi, we offer you exceptional services through a team of professional experts in the field of fashion and style. Our Service Providers collaborate with you to ensure the best possible experience, tailored to your personal needs. Accordingly, the Application allows Service Providers to display their services within the Application, enabling Customers to view them and place service requests through the Application.
We allow the Customer to browse the services available through the Application, whether provided directly by the Application through its team or by Service Providers registered on the Application, and then submit a service request in accordance with our established procedures.
(4) Account
Account Creation: The FC by Noha Sindi Application allows Users to create personal accounts to access the services provided. The User shall provide accurate and complete information during registration, including their name, email address, phone number, and any other required details. The User acknowledges that they are responsible for updating their account information to ensure its accuracy and correctness at all times.
Eligibility for Registration: Registration on the Application shall only be permitted for those who have reached the legal age in accordance with the laws of the Kingdom of Saudi Arabia or those who possess the legal capacity to enter into contracts. FC by Noha Sindi reserves the right to refuse any registration request or cancel the account of any User if there is suspicion of providing false information or violating the Terms and Conditions.
Confidentiality of Account Information: The User shall be bound to bear full responsibility for maintaining the confidentiality of their login details, including the username and password. The User shall be bound to bear responsibility for any activities conducted through their account, whether authorized or unauthorized. The User shall be bound to notify FC by Noha Sindi immediately in the event of any suspected unauthorized use of their account.
Legitimate Use of the Account: The account shall be used for personal purposes only and shall not be used for any commercial or unlawful purposes. Sharing login details with any third party or allowing others to use the account on behalf of the User shall be prohibited. The User shall not use the account in any manner that may damage the Application, its reputation, or violate any laws or the rights of third parties.
Inactive Accounts: If the User creates an account and fails to activate it within [30] days from the registration date, FC by Noha Sindi shall have the right to cancel the account automatically without prior notice.
Inactive Accounts: An account shall be considered inactive if the User has not logged in or used any of the Applications services for a continuous period of [12] months. FC by Noha Sindi shall have the right to suspend or delete inactive accounts at its sole discretion. A notification shall be sent to the User via email or any available communication method before any action is taken regarding the inactive account, with the possibility of reactivation within a specified period according to the Application’s policy. The User may be required to re-register if they wish to use the Application after the inactive account has been cancelled.
Account Cancellation and Suspension: The User shall have the right to request the cancellation of their account at any time through the account settings within the Application or by contacting customer support. FC by Noha Sindi shall have the right to suspend or cancel any account without prior notice in the following cases:
Violation of any of the terms and conditions of the Application.
Provision of false or misleading information during registration or while using the account.
Any illegal or fraudulent activity conducted through the account.
Misuse of the services or attempts to manipulate the Application’s systems.
Data Protection and Privacy: The use of the account shall be subject to the privacy policy adopted by FC by Noha Sindi, which outlines how users personal data is collected, processed, and protected. Users information shall not be shared with any third parties except as required by applicable laws or with the Users consent.
Revocation of License: FC by Noha Sindi shall have the full right to revoke the license granted to the User to use the account or the Application at any time, at its sole discretion, without the need to provide prior notice or give any reasons. The Application shall not be held liable to the User or any other party for any losses or damages resulting from the revocation of the license or account cancellation.
In the event of account cancellation due to non-activation, inactivity, breach of the agreement, revocation of the license, or any other reason, the User shall not have the right to recover any data or content associated with the deleted account. FC by Noha Sindi shall not be held liable for any losses that may arise as a result of account cancellation in accordance with this policy.
(5) Usage Policy
Acceptance of Terms: By using the FC by Noha Sindi Application, the User shall agree to comply with all the terms and conditions set forth in this Agreement. If the User does not agree to any of these terms, the User shall immediately cease using the Application.
Legal Use: The user shall be bound to use the Application legally. The user shall be bound to use the Application and the services available through it solely for lawful and permitted purposes as defined by FC by Noha Sindi. The user shall ensure seriousness and credibility when utilizing the services provided and shall adhere to the principle of good faith in dealings. The user shall refrain from any attempts to manipulate the Application or deceive any parties interacting with it in any manner.
Protection of Account and Personal Information: The Customer shall be bound to maintain the confidentiality of their login details and shall not share them with any other person. The Customer shall be bound to notify FC by Noha Sindi immediately in the event of any suspected unauthorized use of their account. The collection and processing of personal data shall be governed by the privacy policy adopted within the application.
Accuracy and Updating of Information: The Customer shall be bound to enter all required information in the application accurately and honestly, and shall be fully responsible for its accuracy, timeliness, and compliance with applicable laws and regulations. The Customer shall be bound to update this information promptly whenever any changes occur to ensure its continued accuracy.
Prohibited Activities: The user is prohibited from engaging in any of the following activities:
Attempting to hack or disrupt the application systems or exploiting any security vulnerabilities.
Using the application in any way that may cause disturbance or harm to other users or service providers.
Damaging or disrupting the service or negatively impacting the user experience of other users.
Providing misleading or fraudulent information, or impersonating another individual.
Using the application to publish illegal, inappropriate, misleading content, or content that infringes the intellectual property or privacy rights of any third party.
Any use involving misrepresentation, fraud, unauthorized or fictitious communication, or any action that may harm any party.
Engaging in any conduct that could damage or harm the reputation of the application, either directly or indirectly.
Causing any losses or damages to FC by Noha Sindi, including any legal claims that may arise due to misuse.
Suspension or Restriction of Access: FC by Noha Sindi reserves the right to suspend or revoke the users access to the application at any time, without prior notice, if the user violates the usage policy or for any other reason at the sole discretion of the application. The application shall not be held liable for any damages that may arise due to the suspension or termination of the account or service.
Reporting Illegal Activities: If the user discovers any illegal activities or practices occurring through the application, they shall be bound to report it immediately to FC by Noha Sindi via the available official channels, to ensure that appropriate actions are taken in a timely manner.
Reviews and Comments: The User shall ensure that all reviews and comments submitted via the application are truthful and objective, and do not contain any defamatory, abusive, or infringing content relating to the Application, its affiliates, or any third parties. Such reviews must comply with applicable laws and regulations, as well as the review policy established by the Application
Prohibition of Communication Outside the Application:Customers and service providers are prohibited from conducting any transactions or communication outside the framework specified by the Application. In the event of such conduct, FC by Noha Sindi reserves the right to take appropriate actions, including account cancellation, clearing the electronic wallet, and deducting any outstanding amounts, whether current or future, to ensure full compliance with the Applications policies.
(6) Customer Conditions
Account Responsibility: The Customer shall be legally eligible to request the services available through the Application. The Customer shall be solely responsible for their account associated with the information provided in the Application and shall bear full responsibility for any unauthorized or unlawful use of their account within the Application.
Role of the Application in Service Provision: The services offered through the Application shall be provided as follows:
Services Provided by the In-House Team: Some of our services shall be directly provided to Customers. In such cases, we shall assign our in-house team to deliver the requested services directly to the Customer.
Services Provided by Service Providers: Certain services in the Application shall be offered by independent Service Providers registered within the Application. By requesting such services, the Customer agrees to receive the services from an independent Service Provider without any direct intervention from FC by Noha Sindi.
Selection of the Service Provider: The Customer shall be solely responsible for selecting the appropriate Service Provider from the directory available within the Application, without any intervention from FC by Noha Sindi. The Customer also acknowledges that prices may vary among Service Providers based on the rates set by each individual Service Provider.
Independence of Service Providers: The Customer acknowledges that the Service Providers are not employees of FC by Noha Sindi and that the Application does not exercise any supervisory or regulatory authority over them. Service Providers operate entirely independently, and the role of the Application is limited to facilitating access to Service Providers and organizing service utilization only.
Service Location: The Customer shall be responsible for selecting the service location and ensuring that it is suitable and safe to maintain the personal safety of the Customer, the team, and the Service Providers. The Application shall bear no responsibility for meeting locations or any consequences that may arise therefrom.
Maintaining Personal Privacy: The Customer shall take the necessary precautions to maintain their privacy and safety while receiving the service. The Application shall not be responsible for any violations committed by Service Providers concerning the Customer’s privacy or personal life. The services shall be provided under the full supervision of the Customer.
Respect and Professionalism: The Customer shall conduct themselves with respect and professionalism when interacting with the Service Provider and the Application’s team, refraining from any inappropriate behavior that may affect the relationship between the parties. The Customer shall be responsible for any actions taken while using the Application or receiving the service, including any unlawful or unethical conduct that may cause harm to the Service Provider or any other party.
Refraining from Direct Contracting Outside the Application:The Customer shall be bound to refrain from entering into any agreements or contracts with Service Providers outside the scope of the Application. In the event of a violation, the Application shall have the right to take appropriate measures, including account suspension and termination of services provided to the Customer.
Legal Use of Services: The Customer shall be bound to use the services provided through the Application in a legal manner and shall not exploit them for any activities that violate applicable laws and regulations. The Customer shall also be bound to comply with all terms set forth in this agreement and any relevant laws.
Account Suspension in Case of Violation: The Application shall reserve the right to suspend or cancel the Customers account at any time if it is found that the Customer has violated any of the terms and conditions outlined in this document, without the need for prior notice.
Disclaimer of Liability: The Customer acknowledges and agrees to release the Application from any liability arising from the provision of services, including any personal or professional actions taken by the Service Provider during the execution of the service.
(7) Service Providers Conditions
Qualifications and Licenses: The Service Provider must be academically and professionally qualified in the field in which they provide services through the application, and must hold the necessary licenses to practice the profession in accordance with the applicable regulations. The Service Provider shall be bound to provide documents proving their qualifications and required licenses, and shall bear full legal responsibility in case of any inaccuracies, invalidity, or expiration of such documents.
Registration and Account Use: The registration of a service provider account and the provision of services to customers through the application are subject to the following terms and conditions:
The registration of the service provider with us is based on personal consideration, and therefore, they are not allowed to transfer or share their account with others.
The application reserves the right to verify the accuracy of the service provider’s information before approving their registration and may suspend or terminate the account if it is proven that the service provider lacks sufficient expertise or engages in prohibited practices.
The service provider is prohibited from registering more than one account, and if discovered, the application has the right to suspend or delete the violating accounts without prior notice.
The service provider is fully responsible for any unauthorized or illegal use of their account and will bear the consequences thereof.
Pricing and Financial Obligation: The service provider is committed to clearly disclosing the prices of services through the application and must apply the stated prices without any unjustified increases when dealing with customers. The service provider is not allowed to request any additional amounts from the customer outside the scope of the agreement made through the application.
Quality of Services and Customer Interaction:The service provider shall commit to the highest standards of quality and professionalism in delivering services and interacting with customers as follows:
The service provider shall undertake to deliver services according to the highest standards of quality and professionalism, in line with the description advertised through the application and the customers needs.
Services shall be provided within the agreed-upon timeframe with the customer, and delays shall only occur due to force majeure.
The service provider shall refrain from using any materials or tools that may cause harm to the customer and shall be fully responsible for any damage arising from this.
The service provider shall be responsible for performing the work with efficiency and precision, taking the necessary care to ensure customer satisfaction.
The service provider shall treat customers with respect and shall refrain from any inappropriate conduct or offensive language.
Privacy and Confidentiality of Information:The service provider shall be bound to respect the privacy of the customer and the place of service provision as follows:
The service provider shall be bound to refrain from disclosing any personal information about the customer or using it for any unlawful purposes or in violation of the applications privacy policy.
The service provider shall be bound to refrain from taking photographs of the customer or recording any visual or audio materials related to the customer without prior written consent, and from publishing any such materials through any means without the explicit consent of the customer.
The service provider shall be bound to refrain from using a mobile phone or any other recording device during service provision, except in cases deemed necessary and acceptable by the customer.
Legal Independence of Service Providers: The service provider shall acknowledge that their work is entirely independent from the application, that they are not an employee of the application, and that the application has no supervisory or regulatory authority over them. The application shall not be held liable for any legal or contractual responsibility for any actions or conduct performed by the service provider during the provision of services.
Additional Obligations and Guarantees of Performance:The service provider shall be bound to all obligations and guarantees necessary for the professional execution of the service for the customer, including but not limited to the following:
The service provider shall be bound not to cancel any agreed-upon services with the customer without a valid reason. If unable to perform the service, the service provider must notify the customer in advance.
The service provider shall be bound to ensure that all services provided comply with applicable laws and regulations and do not harm the customer in any way.
The service provider shall be fully responsible for any damages incurred by the customer as a result of the service providers negligence or failure to perform during the execution of the service.
The service provider shall be bound not to attempt to contact customers outside the scope of the application for any unauthorized personal or business purposes.
Violation Procedures and Penalties: The application shall have the right to suspend or terminate the service providers account in the event of any violation of these terms without prior notice. In the event that the service provider commits any violation of the customers or the applications rights, we shall be entitled to take the necessary legal actions to protect the rights of the affected parties.
(8) Booking Policy
Service Request: The FC by Noha Sindi application allows customers to book services provided through the application or by service providers registered within the application.
Booking Procedures and Steps: Booking any of the services provided through the app is subject to the following rules and steps:
The customer shall be required to register in the app and create a personal account, which shall be activated by the app before being permitted to use the services.
After account activation, the customer may browse the available fashion and styling services, which include services offered via the app, such as: (clothing selection and coordination, wardrobe recycling and organization, adding organizational elements like hangers or storage drawers, designing celebrity-inspired looks, and any other services available through the app).
The customer may select the appropriate service provider through the app based on the reviews and the announced prices.
Once the customer selects the desired service, a detailed description of the service shall be displayed, including the nature of the service and its specific requirements. The customer shall be required to enter all required information accurately to ensure optimal service delivery.
After that, the customer shall be redirected to the payment page, where they will specify the booking details, which include: (service execution time and the location where the service will be provided).
Confirmation and Management of Bookings: The confirmation and management of bookings shall be subject to the following rules:
A booking constitutes an official confirmation of the service request, and the customer must verify the booking details before finalizing it.
The booking shall be considered confirmed once the customer receives the confirmation notification via the app.
The app and/or service provider shall provide the service according to the specifications and the scheduled time, and the customer is required to attend the appointment and comply with the service terms.
The customer shall adhere to the scheduled appointment and arrive at the specified time.
The service provider shall execute the service according to the agreed-upon specifications and shall not cancel the booking except in accordance with the cancellation policy.
The customer has the right to manage their bookings through the app, including rescheduling or canceling, in accordance with the approved cancellation policy.
Modifying the booking: In the event the customer wishes to modify the booking details, this shall be in accordance with the rescheduling provisions outlined in our approved cancellation policy.
Failure to Attend: If the Customer fails to attend at the scheduled time without prior notice, the Service Provider shall be entitled to consider the service as canceled, and the Customer shall be liable to pay any applicable fees in accordance with the Cancellation Policy.
Breach of Reservation: In the event that the Service Provider fails to attend or perform the service as per the reservation, the Customer shall be entitled to file a complaint, and appropriate action shall be taken in accordance with the application’s policies.
The application shall not be held responsible for any reservations or agreements made outside the platform. Customers and Service Providers shall be bound to adhere to the approved booking system through the application.
(9) Cancellation Policy
Cancellation by the Customer: The customer may cancel the reservation under the following circumstances:
The customer may cancel or reschedule the reservation free of charge if done at least 48 hours before the scheduled service time.
If the cancellation or rescheduling occurs between 48 hours and 3 hours before the scheduled time, 50% of the service fee will be deducted.
If the cancellation occurs less than 3 hours before the scheduled time, 100% of the service fee will be deducted, and the customer will not be eligible for any refund.
The customer shall be bound to submit the cancellation or rescheduling request through the application to ensure the proper organization of operations and to avoid causing harm to the application or service providers.
Cancellation of Reservation by the Service Provider:The cancellation of a reservation by the service provider is subject to the following provisions:
The service provider shall be bound to uphold their obligations and shall cancel reservations only in cases of extreme necessity or force majeure, with immediate notification to the customer via the application (provided that the justification is acceptable to the application).
If the service provider repeatedly cancels reservations or cancels without an acceptable justification, the application reserves the right to take appropriate actions, which may include suspending or deactivating their account.
If the cancellation is made by the service provider, the customer shall be entitled to a full refund of any amounts paid, if any, or to reschedule the service without any additional charges (if the customer accepts the rescheduling).
Waiting Time: The customer shall be bound to the scheduled service time, and to ensure better service delivery, the waiting time at the service location is as follows:
The customer shall be bound to arrive at the scheduled time, and shall allow the team or service provider to wait for up to 45 minutes maximum after the scheduled time.
If the customer is delayed for more than 45 minutes without prior notice, the team or service provider shall be entitled to leave and cancel the reservation, considering it a late cancellation, which shall result in a 100% charge of the service fee.
If the team or service provider is delayed beyond the scheduled time without prior notice, the customer shall be entitled to cancel the reservation without any charges.
Violation of the Cancellation Policy:Customers and service providers shall be bound not to agree to cancel outside the application or to circumvent the terms mentioned above. The application shall have the right to suspend or cancel the account of any user found to have violated or abused the cancellation policy, including repeated cancellations without acceptable justification.
(10) Product Delivery Policy
Product Delivery Mechanism: The application does not provide separate shipping or delivery services for purchased products. Products are delivered directly to the customer by the team or service provider during the execution of the service agreed upon through the application.
Product Receipt Details: When a customer purchases a product through the application, product receipt will be coordinated with the service execution appointment. The relevant service team will deliver the product to the customer at the pre-designated location. The customer cannot request independent delivery of the product or through a third party, as it will only be delivered as part of the service provision.
No Shipping Costs: Due to the approved product delivery method, the customer will not incur any additional shipping costs, as products are delivered without shipping fees as part of the service.
Responsibility for Receipt: The customer is responsible for receiving the product during the execution of the service. If the product is not received at the scheduled time, the application will not be responsible for any subsequent claims related to non-receipt.
In case of any inquiries or issues related to product delivery, the customer can contact customer service through the application.
(11) Return Policy
Product Review and Receipt: The customer has the right to inspect the product immediately upon receiving it from the team or service provider during the service execution. The product may be returned immediately before the team or service provider leaves, provided it is unused, in its original condition, with all accessories and original packaging.
Return After Receipt: After the team or service provider leaves, the customer may return products eligible for return within 7 days from the date of receipt, in accordance with the terms and conditions of the Saudi Electronic Commerce Law and its executive regulations. The product must be in its original condition, unused, undamaged, and accompanied by the original invoice and any accessories that came with it.
Non-returnable Products: Products that have been used or damaged after receipt cannot be returned. Products classified as personalized services designed specifically for the customer or products that cannot be resold for health or hygiene reasons are non-returnable, except in the case of a verified manufacturing defect.
Return Request Process: If the customer wishes to return a product after receipt, a return request must be submitted via the application within the specified period. The request will be reviewed, and the eligibility of the product for return will be verified. The customer will then be informed of the necessary steps to complete the return process.
The application reserves the right to reject a return request if the above-mentioned conditions are not met.
The application has the right to amend the return policy in accordance with the requirements of the applicable laws and regulations in the Kingdom of Saudi Arabia.
(12) Pricing Policy
Pricing Mechanism: The prices for services and products in the FC by Noha Sindi application are based on several factors, and they are determined as follows:
Hourly Services: The cost of the service is calculated based on the number of hours required.
Services with Minimum Hour Requirements: A fixed price is determined for services that require a minimum amount of time.
Additional Hours: If the customer exceeds the agreed-upon service time, additional charges will be applied for each extra hour, in accordance with the price announced in the application.
Product Prices: The prices of products available in the application are determined according to the published price quotes, and the price includes all applicable costs at the time of purchase.
Price Transparency: All prices announced in the application are final and inclusive, with no hidden fees. Pricing details are clearly displayed before completing the booking or purchase process, ensuring that the customer agrees to the price before confirming the order. Service providers dues are transferred within two working weeks from the date the payment is received from the customer.
The application verifies the proper completion of the service and ensures the order has not been canceled before proceeding with the transfer of dues.
If the order is canceled or if the service is not completed according to the standards set by the application, the transfer of dues will be delayed or canceled, depending on the orders status.
Terms and Conditions for Dues Transfer:
The service provider must complete the service on time and ensure it is successfully carried out according to the requirements and conditions set forth in the agreement between the customer and the service provider.
Payments are transferred through the available payment methods provided by the application (such as bank transfer or electronic payment gateways).
If there are any objections or issues related to the payments, the service provider must contact the customer support team for assistance and resolution of the issue.
Legal Responsibilities of the Service Provider: The service provider shall bear full responsibility for delivering the service in a professional manner and in compliance with the applications standards. The service provider must ensure that the service is provided according to the required specifications, and in the event of any violations or failures in service delivery, the service provider shall be ineligible to receive the dues.
Under this policy, service providers agree to the fees deducted from the amounts paid and the terms related to the transfer of financial dues through the FC by Noha Sindi application.

Email: Email is one of the primary means of communication with users regarding important notifications such as booking confirmations, service updates, and account alerts. Users should ensure the accuracy of the email address registered in the application.
Short Message Service (SMS): Text messages are sent to users to confirm orders, emergency alerts, or urgent changes that may affect the provided service. Users should ensure the accuracy of the mobile phone number registered in the application.
In-App Notifications: The application provides in-app notifications to update users on activities related to their accounts, including updates on orders, new messages from service providers, or any other notifications related to using the application.
Registration and Consent for Notifications:By using the application, the user agrees to receive all notifications and communications related to their account and services provided through the application. The user commits to providing accurate and up-to-date contact information to enable the application to communicate with them effectively.
Unsubscribing from Marketing Notifications:If the user does not wish to receive marketing notifications or promotional offers, they can unsubscribe from these notifications through their account settings in the application or via the Unsubscribe link found in marketing email messages.
Updating Contact Information: Users are required to update their contact information if there are any changes to their email address or mobile phone number. Users should ensure that their information is accurate to ensure they receive important notifications correctly.
Notifications with Limited Validity: In the case of notifications with a limited validity period (such as limited-time offers or updates), users must take the required actions within the specified timeframe. Once the validity period expires, the notification may no longer be valid or have any effect.

(26) Modifications
Right of the Application to Modify Policies and Terms:The application reserves the right to modify or update any of its policies, including the Terms and Conditions, Privacy Policy, Payment Policy, Cancellation Policy, and other related policies, as it deems appropriate to ensure the best service for users and comply with legal and regulatory requirements.
User Notification of Changes: Users will be notified of any significant changes to the policies through one of the following means: (in-app notifications, email sent to the registered user account, or posting the amendments on the website or within the app). Continued use of the application after the amendments are published shall be considered as the user’s implicit consent to the new changes.
Effective Date of Modifications: Any changes to the policies shall be effective immediately upon publication within the app or within the time frame specified by the application in the notice sent to users. If the user does not agree to the new modifications, they may stop using the application and delete their account.
Users Responsibility to Monitor Changes: It is the users responsibility to periodically review the policies to stay informed about any updates or changes. The application shall not be held responsible for the user’s failure to review the modifications if they have been announced via official channels.
Emergency or Legal Modifications: If regulatory authorities or competent authorities impose any legal changes affecting the application or its services, the policies will be modified in accordance with these changes without prior notice. Some modifications may be made immediately if they relate to improving the user experience or enhancing security within the application.
Retention of Previous Versions of Policies:The application may provide an archived version of previous policies for reference purposes. However, the most current version published through the app or website shall be considered the official version.
(27) Term of the Agreement
Commencement of the Agreement: This agreement becomes effective upon the users account registration in the application or the first use of the services provided through the app. It remains in effect throughout the users use of the app and its associated services.
Termination of the Agreement by the User:The user has the right to terminate the agreement at any time by closing their account and deleting the app from their devices, provided that any outstanding financial or legal obligations are fulfilled prior to termination.
Termination of the Agreement by the Application:The application has the right to terminate the agreement or suspend the account in the following cases:
Violation of any of the terms, conditions, or approved policies by the user.
Misuse of the services or causing harm to the application or other users.
Providing incorrect or misleading information during registration or while using the app.
Any other reasons that the application deems necessary to protect its commercial or legal interests.
Effect of Termination of the Agreement: In the event of termination, the user shall lose access to their account and related services, and they shall not be able to retrieve any stored data or content within the application. Certain obligations shall remain in effect even after termination, such as settling any outstanding financial dues and complying with any other legal obligations. The application shall not be required to provide any compensation or refunds if the agreement is terminated due to a violation of the terms or misuse of the services.
Modification of the Agreement Term: The application reserves the right to modify the duration of the agreement or the termination conditions as it deems appropriate. Users shall be notified of any material changes in accordance with the approved modification policy.
(28) Governing Law
This Agreement, along with all related policies and any disputes or claims arising from the use of the application or the services provided through it, shall be governed by and construed in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia.
The Customer and the Service Provider shall comply with all relevant Saudi laws and regulations, including but not limited to the E-Commerce Law and its Executive Regulations, the Electronic Transactions Law, the Personal Data Protection Law and its Executive Regulations, the Cybercrimes Law, and other applicable regulations.
In the event that any provision of this Agreement conflicts with the applicable laws, such provision shall be interpreted in accordance with the prevailing laws without affecting the validity of the remaining terms and conditions of the Agreement.
(29) Jurisdiction and Competent Courts
In the event of any dispute or claim arising from the use of the application or any of the services provided through it, the parties shall first attempt to resolve the dispute amicably by communicating with the application’s management.
If the dispute cannot be resolved amicably within fifteen (15) days from the date of the official notice, all parties agree that the competent courts in the Kingdom of Saudi Arabia shall have exclusive jurisdiction to hear and settle any legal dispute arising from this Agreement or any related policies.
The Customer and the Service Provider acknowledge that they shall not file any legal claims against the application, its owners, or its operators before any court or judicial authority outside the Kingdom of Saudi Arabia. Any legal action taken in violation of this provision shall be considered invalid and legally unenforceable.
(30) Arabic Language
Arabic is the official and legally recognized language for all terms, conditions, and policies related to the use of the application, including any documents, notifications, or communications issued by or concerning the services provided through the application.
In the event that this Agreement or any of its related policies are translated into another language, the Arabic text shall be the authoritative and legally binding version in the event of any discrepancy or conflict in interpretation between the Arabic text and any translation.
The Customer and the Service Provider agree that all official transactions within the application, including contracts, invoices, reviews, and complaints, shall be conducted in Arabic. The application shall not be held liable for any errors resulting from unofficial translations of any of its documents or policies.
